The reason why the pathologists are usually reluctant to use (+) cases, is because if they are used as a (+) controls they will be probably used up totally within a short period of time and IF there is some sort of legal action against them or the hospital in one of those cases there will be no a block to return to and make additional sections for litigation purposes, and it is an understandable position.

Thanks everyone!  I also thought that we should be using positive patient 
controls but our pathologist wasn't to keen on the idea for some reason. 
But now with all of your responses maybe we will be.
